Welcome to SamBella Kids (“SamBella Kids,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of the SamBella Kids mobile application, website, and any related services (collectively, the “Services”).

By downloading, installing, accessing, or using the Services, you agree to these Terms. If you do not agree, please do not use the Services.

1) Who Can Use SamBella Kids

SamBella Kids is designed for families and may be used by children. If you are a parent or legal guardian, you are responsible for supervising your child’s use of the Services.

You must be at least 18 years old (or the age of majority in your location) to create an account or purchase a subscription.

2) Accounts and Login

Some features may require an account.

When you create an account, you agree to:

  • Provide accurate information

  • Keep your login credentials confidential

  • Notify us if you believe your account has been accessed without permission

You are responsible for all activity that occurs through your account.

3) Subscriptions and Payments (If Applicable)

Billing

Subscriptions are billed through the platform you used to purchase (e.g., Google Play). Your purchase is subject to the platform’s payment terms.

Renewal

Subscriptions may automatically renew unless canceled before the renewal date.

Cancellation

You can cancel your subscription anytime through your Google Play account settings. After cancellation, you will retain access through the end of your billing period.

Refunds

Refunds are handled by the platform provider (e.g., Google Play) and subject to their refund policies.

4) License and Permitted Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use SamBella Kids for personal, non-commercial, family use.

You agree not to:

  • Copy, reproduce, or distribute the app or content except as permitted

  • Sell, rent, lease, or sublicense any part of the Services

  • Attempt to reverse engineer, modify, or create derivative works

  • Use the Services for unlawful, harmful, or abusive purposes

  • Interfere with the security or operation of the Services

5) Content and Intellectual Property

All content in the Services—including stories, illustrations, audio, design, logos, and app features—is owned by SamBella Kids or its licensors and protected by copyright and other laws.

You may not use our trademarks, branding, or content without written permission.

6) User Content (If Applicable)

If the Services ever allow you to submit content (such as feedback, support messages, or suggestions), you grant us permission to use it to operate, improve, and support the Services.

You promise that anything you submit does not violate any laws or infringe on anyone else’s rights.

7) Privacy

8) Service Availability and Changes

We work hard to keep the Services available and reliable, but we do not guarantee uninterrupted access.

9) Disclaimer of Warranties

The Services are provided “as is” and “as available.”

To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that:

  • The app will always be error-free

  • Any content will meet every user’s needs

  • Access will always be uninterrupted

10) Limitation of Liability

To the fullest extent permitted by law, SamBella Kids will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, resulting from your use of the Services.

Our total liability for any claim will not exceed the amount you paid for the Services in the 12 months prior to the event giving rise to the claim (or $10 if you paid nothing).

11) Termination

You may stop using the Services anytime.

We may suspend or terminate access if:

  • You violate these Terms

  • Use is harmful, abusive, or illegal

  • Required to comply with law or protect the Services

12) Governing Law

These Terms are governed by the laws of the State of Colorado, United States, without regard to conflict of law principles.

13) Changes to These Terms

We may update these Terms from time to time. When we do, we will update the “Effective Date” above. Continued use of the Services after changes means you accept the updated Terms.
